Important Things that Whistleblowers Should Know

The reputations of whistleblowers are different from one another. There are some who expose something that people do wrong, fraud, and corruption, and thus to the public, they become our heroes. There are also those who leak out information, but the result is that they get a bad name for themselves that no one wants to take them in for employment. Are you a whistle blower, or are you planning of becoming a whistle blower soon? You need to protect yourself, and below are some ways on how you can do so.

If a person reports, opposes, or refused to engage in the violation of laws, rules, or regulations, there are whistleblower laws that protect them. Whistleblower laws also protect people who don’t work overtime without pay, or who don’t want to violate environmental laws since they either care for the environment or merely for their own safety. These laws also protect people who report violations to government agencies, to the upper management, or to unions.

There are some types of complaints that are not under the protection of whistle blower laws. Like, you need to believe that what you are reporting is really illegal and a violation of laws or rules. You cannot use the whistleblower law protection if you refuse to do something because you just don’t want to do it. Sexual harassment complaints are protected by whistleblower laws while discrimination against employees is not.

If a whistleblower is seeking protection from retaliation, his case can be hurt if the wrongdoing was reported to the wrong person. Make sure that you report the case to the appropriate legal authority. Taking time to come out with your complaints can be greatly affected if the statute of limitations has already been reached, and by this time you can no longer sue the offenders.

if you are going to expose some important issues, make sure that there is a law that is violated and that there is a valid lawsuit on your hands. There is a site on the internet which deals with whistleblowers and other relevant matters.

It is important to make documentation of what you have done from the start. You will need to document that which you have witnesses, the time and place that it has happened, and the people who were involved in the event. You need to support your claims with copies of timecards, emails, and records. As you attempt to report issues, continue to document matters. You should respect the chain of command when reporting before going beyond someone’s head. Reporting an employer who is violating labor laws to his immediate superior is the proper chain of command to be observed, and not to anybody else.

If the matter reaches court, you already have valuable evidence in your documentation.

You need to understand what whistleblowing is and what it is not.
